Newborn baby’s death sparks medical malpractice claim

| Mar 6, 2020 | Firm News, Medical Malpractice

A woman in a neighboring state recently claimed that a doctor’s negligence caused the death of her newborn baby. She has thus filed a lawsuit against the doctor as well as multiple facilities, claiming medical malpractice. Likewise, the loved ones of any person who dies due to medical negligence in Indiana has the right to seek justice through the civil court system.

In the recent out-of-state case, the woman claimed that her doctor did not properly monitor her labor both before and during her delivery. As a result, she reportedly did not deliver her baby boy in an appropriate amount of time. She claimed that this caused her baby’s brain to lack the blood and oxygen it needed.

According to the lawsuit, the doctor’s negligence caused the mother and other members of the family to suffer emotional trauma stemming from the loss of the baby. In addition, the woman reportedly incurred funeral expenses totaling about $10,000. In light of this, the woman is seeking damages totaling over $25,000.

Unfortunately, sometimes, medical doctors in Indiana and elsewhere fail to exercise a reasonable degree of care when tending to patients. In this situation, they can easily cause their patients to suffer serious injuries or even death. Fortunately, those who lose their loved ones due to medical malpractice have the right to file civil claims against the allegedly at-fault physicians, seeking the reimbursement of financial damages. An understanding of what facts must be proved will likely be necessary to prevail in this type of case.
